Welcome to WL Alert. These Terms of Service govern your access to and use of the WL Alert website and platform at wlalert.com.
By creating an account or using WL Alert in any way, you agree to be bound by these Terms. If you do not agree, please do not use the service. These Terms are written in plain language so you clearly understand what you are agreeing to.
1. About WL Alert
WL Alert is an independent, third-party alert notification platform that connects to your WeatherLink account via the official WeatherLink API. It monitors your Davis weather station data and sends threshold-based alerts via email and SMS to recipients you define.
WL Alert is not affiliated with, endorsed by, or officially connected to Davis Instruments or WeatherLink.com.
2. Eligibility
To use WL Alert, you must meet the following requirements:
- Be at least 18 years of age
- Hold a valid WeatherLink account with at least one registered Davis weather station
- Provide accurate and complete information when creating your account
- Be legally capable of entering into a binding agreement in your jurisdiction
By using WL Alert, you confirm that you meet these requirements. We reserve the right to suspend or terminate accounts that do not meet eligibility criteria.
3. Your Account
When you register for WL Alert, you are solely responsible for:
- Keeping your login credentials secure and confidential
- All activity that occurs under your account
- Notifying WL Alert immediately if you suspect unauthorized access to your account
- Ensuring the contact details and API credentials you provide remain accurate and up to date
WL Alert will never request your password via email, SMS, or any channel outside of the official login page at app.wlalert.com.
4. WeatherLink API Credentials
To use WL Alert, you must provide your WeatherLink API key and secret. By entering these credentials, you confirm that:
- You authorize WL Alert to access your WeatherLink station data on your behalf
- You are the legitimate owner or authorized user of the WeatherLink account associated with those credentials
- You accept full responsibility for any consequences arising from providing your API credentials to WL Alert
WL Alert uses your API credentials solely to read live weather data for the purpose of evaluating your alert rules. Your credentials are stored in encrypted form, are never shared with third parties, and are never used for any other purpose. You may revoke access at any time by removing your credentials from WL Alert or regenerating your API key in your WeatherLink account settings.
5. Plans, Pricing, and Payments
WL Alert offers a free plan and several paid subscription plans as described on the Pricing page. By subscribing to a paid plan, you agree to the following:
Billing
Paid plans are billed on a monthly basis and renew automatically on your billing anniversary date. By subscribing to a paid plan, you authorize WL Alert to charge your chosen payment method for the applicable plan fee each billing cycle unless you cancel before the renewal date.
Refunds
Because WL Alert is a digital subscription service, payments are generally non-refundable once a billing cycle has begun. Refund requests are reviewed on a case-by-case basis. If you believe you have been charged in error or have a legitimate concern, contact us directly and we will work toward a fair resolution.
Plan Changes
You may upgrade or downgrade your plan at any time. Changes take effect at the start of your next billing cycle. Monthly delivery credits reset on your billing anniversary and do not carry over between billing periods unless otherwise specified.
Add-On Credit Packs
Add-on credit packs are one-time purchases and are non-refundable once applied to your account. Add-on credits are consumed after your monthly plan credits are exhausted and do not expire while your account remains active.
Custom Pricing and Negotiations
WL Alert is open to custom pricing arrangements for schools, community organizations, agricultural cooperatives, research institutions, and other users with specific needs. Custom arrangements are handled on a case-by-case basis and must be confirmed in writing via email before taking effect.
6. Delivery Credits and Alert Limits
Each email or SMS notification sent by WL Alert consumes one delivery credit from your monthly plan allowance. You are responsible for monitoring your credit balance and purchasing add-on packs if additional credits are needed before your monthly reset.
WL Alert is not liable for missed or undelivered alerts resulting from exhausted delivery credits. Alert rules that exceed your plan’s active rule limit will not fire until rules within your plan limit are available.
7. Acceptable Use
By using WL Alert, you agree not to:
- Use the service for any unlawful, harmful, or fraudulent purpose
- Attempt to gain unauthorized access to WL Alert’s systems, servers, or databases
- Reverse engineer, decompile, or attempt to extract the source code of the WL Alert platform
- Use WL Alert to send unsolicited or spam messages to recipients who have not consented to receive them
- Add recipient contact details without the knowledge and consent of those individuals
- Misrepresent your identity or impersonate any person or organization
- Interfere with or disrupt the operation of WL Alert or the WeatherLink API
- Resell, sublicense, or commercially exploit WL Alert without prior written permission
Violation of these acceptable use terms may result in immediate account suspension or termination without refund.
8. SMS and Email Notifications — Your Responsibility
When you add recipient email addresses or phone numbers to your alert rules, you confirm that:
- You have obtained the informed consent of each recipient to receive automated weather alert notifications from WL Alert
- The contact details you provide are accurate and belong to real, consenting individuals
- You will promptly remove any recipient who requests to be removed from your alert rules
- You will not use WL Alert’s notification system to send unsolicited, harassing, or spam messages to any individual
WL Alert is a tool for legitimate weather monitoring and alert purposes only. Misuse of the notification system is a violation of these Terms and may result in account termination and referral to relevant authorities.
9. Service Availability and Uptime
WL Alert operates on dedicated cloud infrastructure and makes every effort to maintain continuous, reliable service availability. However, we cannot guarantee uninterrupted uptime at all times. Scheduled maintenance, infrastructure issues, third-party API disruptions, or events beyond our reasonable control may cause temporary service interruptions.
WL Alert is not liable for damages, losses, or consequences arising from service downtime, missed alerts, delayed notifications, or delivery failures caused by factors outside our reasonable control, including:
- WeatherLink API outages or changes made by Davis Instruments
- SMS gateway delivery failures or mobile network-side delays
- Email delivery failures caused by recipient spam filters or email provider policies
- Cloud hosting infrastructure outages or maintenance windows
For critical safety and operational applications, WL Alert should be used as part of a broader monitoring strategy and not as the sole means of detecting dangerous weather conditions.
10. Intellectual Property
All content, design, code, branding, and functionality of the WL Alert platform — including the WL Alert name, website design, alert rule engine, and message builder — are the intellectual property of WL Alert and its respective owners unless otherwise stated.
You are granted a limited, non-exclusive, non-transferable license to use WL Alert for its intended purpose as described in these Terms. You may not copy, reproduce, distribute, or create derivative works from any part of the WL Alert platform without prior written permission.
Alert rules, message templates, recipient lists, and other content you create within the platform remain your own. WL Alert does not claim ownership over any content you create or configure within your account.
11. Third-Party Services
WL Alert depends on third-party services to operate, including:
- WeatherLink API by Davis Instruments — for live weather station data
- SMS gateway providers — for mobile alert delivery
- Transactional email providers — for email alert delivery
- Payment processors — for subscription and add-on billing
- Cloud hosting providers — for platform infrastructure and uptime
WL Alert is not responsible for the availability, accuracy, or actions of these third-party services. Changes to the WeatherLink API, SMS gateway policies, or other external services may affect WL Alert functionality. We will work to address such changes as promptly as possible but cannot guarantee immediate resolution of issues caused by third-party changes outside our control.
12. Limitation of Liability
To the fullest extent permitted by applicable law, WL Alert and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. This includes but is not limited to:
- Missed weather alerts due to technical failure, credit exhaustion, API disruption, or network issues
- Property damage, crop loss, personal injury, or financial loss resulting from a missed or delayed alert
- Loss of data or account information
- Unauthorized access to your account
- Any decision made — or not made — based on WL Alert notifications or the absence of notifications
In all cases, WL Alert’s total liability to you shall not exceed the total amount you paid for the service in the three months immediately preceding the incident giving rise to the claim.
13. Termination
You may cancel your WL Alert account at any time through your account settings or by contacting us directly. Upon cancellation, access to paid features continues until the end of your current billing period. No further charges will be made after that date.
WL Alert reserves the right to suspend or terminate any account at any time if these Terms are violated, if fraudulent or abusive activity is detected, or if the service is discontinued. In the event of service discontinuation, reasonable advance notice will be provided to active subscribers.
14. Changes to These Terms
These Terms of Service may be updated as WL Alert grows and as legal or operational requirements change. When significant changes are made, the Last updated date at the top of this page will be revised and registered users will be notified by email where appropriate.
Continued use of WL Alert after updated Terms are posted constitutes acceptance of the revised Terms. If you do not agree with any changes, you may cancel your account at any time.
15. Governing Law
These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes arising from the use of WL Alert shall be subject to the exclusive jurisdiction of the appropriate courts in the Philippines, unless otherwise agreed upon in writing by both parties.
